(collectively, “iMemories,” “we,” “our,” or “us”) is your trusted provider of solutions to capture, preserve and deliver recorded memories for families, communities and organizations throughout the United States and Canada. iMemories is dedicated to maintaining and protecting your privacy through our compliance with this Privacy Policy. This includes the privacy of both your information and your home videos and photos.





What does this Privacy Policy cover?

Unless we notify you otherwise in connection with a particular activity, this Privacy Policy explains how we collect and use information your provide us when you do business with us or interact with us, including without limitation communications in email and other electronic messaging, through https://www.imemories.com or any of our other websites, mobile applications and services that link to this Policy (each, an “iMemories Site”) and the choices you can make about the collection and use of your information. This Privacy Policy also addresses how we maintain and protect the privacy of the home videos and photos you submit to iMemories to be digitized, preserved, hosted and delivered to you. It does not apply to information collected by us offline or through any other means, including on any website operated by any third party; or any third party, including through any application or content that may link to or be accessible from or on an iMemories Site.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our website or service. By accessing or using our website or service, you agree to this Privacy Policy. This Privacy Policy may change from time to time. Your continued use after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.





What information do you collect about you and how do we collect it?

We may collect several types of information from and about users of an iMemories Site, including information by which you may be personally identified, such as a name, physical address, or email; information that is about you but individually does not identify you; and information about your internet connection, the equipment you use to access an iMemories Site, and usage details. We collect this information directly when you provide it to us, automatically as you navigate through an iMemories Site, which includes usage details and other information collected through cookies and web beacons, and from third parties, for example, our business partners or other users.

Information You Provide to Us.

We collect personal information and other information from you when you interact with us, such as when you mail or upload your home videos and photos to iMemories; when you register for an account and use an iMemories Site or place an order for products or subscribe to a service; when you contact our customer service representatives; or when you respond to a survey or enter a contest or sweepstakes that we administer. This information may include some or all of the following:

  • Your name
  • Your physical address
  • Your email address
  • Your telephone number(s)
  • Credit card and other payment information
  • Any other identifier by which you may be contacted online or offline
  • Your home videos, photos and other content that you send to iMemories and/or upload to the iMemories Site (“Your Content”).

You may provide third parties access to Your Content on the iMemories Site. Your Content is posted on and transmitted to others at your own risk. Although you may set certain privacy settings for which third parties may view Your Content, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the iMemories Site with whom you may choose to share Your Content. Therefore, we cannot and do not guarantee that Your Content will not be viewed by unauthorized persons.

Information You Provide About Others.

If you choose to share Your Content with someone else through an iMemories Site feature, we will use the personal information you provide (for example the e-mail address of the recipient) to fulfill your request and for other purposes described in this Privacy Policy. Please be aware that your name and/or email address could be provided to us by another user of the iMemories Site for the same purpose.

Information from Social Networking and Third Party Services

An iMemories Site may allow you to interact with or through social networking services such as Facebook, Twitter and Instagram (“Social Features”). Examples of Social Features include enabling you to “like” or “share” content or to log into an iMemories Site using your username and password for the third-party social network. If you choose to connect your iMemories account with a third-party social network, the social network may share information about you with us such as your public profile, e-mail address and friend list. If you choose to “like” or share content, information about you may be publicly displayed on the social network. You should review the privacy policy of that third-party social network and check your privacy settings through that social network. If you post information on a social networking or other third-party service that references iMemories or its products or services (e.g., via a Twitter hashtag), we may publish your post on an iMemories Site.

Information from Automictic Data Collection Technologies

As you navigate through and interact with an iMemories Site, we may use automatic data collection technologies to collect certain technical information from your computer or mobile device over time and across different websites, such as what type of browser you are using, the website from which you enter the iMemories Site, and the pages and content you view and / or select as you tour our site.

The information we collect automatically may include personal information, or we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve the iMemories Site and to deliver a better and more personalized service, including by enabling us to estimate audience size and usage patterns, store information about your preferences allowing customized iMemories Sites, speed up your searches, and recognize you when you return to an iMemories Site. We and our service providers use this information in connection with iMemories marketing programs and to improve our website design and content.

The technologies we use for this automatic data collection may include:

Pages of an iMemories Site and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

How does iMemories use the personal information it collects about you?

We responsibly limit the use and disclosure of your information. We may use your information for the following purposes:

  • to present an iMemories Site and its contents to you;
  • to provide you with information, products or services or benefits that may be of interest to you;
  • to fulfill any other purpose for which you provide it;
  • to develop and improve our products and services and improve the content of our sites;
  • to protect the security or integrity of our databases or website, to take precautions against liability, and to detect and remediate violations of our Terms of Service or other misuse of the iMemories Site; and
  • to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

Your Content remains your property. iMemories will only use Your Content as described in this Privacy Policy.

iMemories does not sell, trade or share your personal information with unaffiliated third parties for their marketing purposes. We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. We may share your personal information with our corporate affiliates for the purposes described in this Policy. If you redeem an offer or order products and services from iMemories in connection with a co-branded promotion we conduct in partnership with another retailer, we may share the information you provide at that time with our retail partner. In such cases, the retail partner's use of your information will be governed by a separate privacy policy, not this policy. We may also share your personal information with third parties who provide support services to us such as helping us fulfill customer orders, process credit card orders and the like. These third parties are authorized to use the personal information solely in conjunction with the specific service they provide to or on behalf of iMemories.

We may also disclose your personal information, including Your Content: (1) to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of iMemories' assets and any preliminary negotiations and diligence thereto, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our users is among the assets transferred; (2) to comply with any court order, law, or legal process, including to respond to any government or regulatory request; (3) to enforce or apply our Terms of Service and other agreements, including for billing and collection purposes; or (4) if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of iMemories, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection.

We never use, share, sell or rent the personal information provided to us online in ways unrelated to the ones described in this Privacy Policy without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.





How does iMemories protect the privacy of my information, including my videos and photos?

The security of your personal information is important to us. We have implemented an information security program that contains administrative, technical and physical controls that are designed to reasonably safeguard personal information. These safeguards include firewalls and the use of Transport Layer Security (TLS) to encrypt pages when collecting or transmitting sensitive information such as your password or credit card information. The safety and security of your information also depends on you. We urge you to be careful about giving out information in any public areas of an iMemories Site. Although we do our best to protect your personal information, unfortunately, the transmission of information via the internet is not completely secure. We cannot guarantee the security of your personal information transmitted to an iMemories Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on an iMemories Site.

We will never make Your Content publicly accessible, except as directed by you or as otherwise noted in this Privacy Policy. Please be aware that, in order to provide quality products, the iMemories employees and agents who work to digitize Your Content, fulfill your order or provide you with customer support may see your home videos and photos in the course of performing their jobs.

iMemories is designed so that you can control who may view Your Content. Sharing your home videos and/or photos electronically through iMemories is one of the key benefits we offer. Please note that if you choose to post a link to your iMemories home videos and photos on your own or others' Web sites, or if you share your photos with your friends or family members and they post your share invitation on a Web site or forward to other individuals, these home videos and photos may be made accessible to others who view the e-mail invitation or visit these Web sites. Be sure to make your wishes known to those you share Your Content with.





What choices do I have about your use of my personal information?

The goal of our marketing and promotional efforts is to inform you about our products and services, including special promotions, that may be of interest to you. We may use your contact information to inform you of offers. However, if you are contacted and do not wish to receive further marketing communications, use the means by which you were contacted to let us know. If contacted by postal mail, return the mail to the sender. If contacted by e-mail, reply to the e-mail sender or use the unsubscribe mechanism within the email. You may also unsubscribe to certain types of notifications through your account “Profile” settings on the iMemories Site.

We will act promptly to honor your request and remove your name from the sender's marketing list. However, even if we remove your name from use in marketing programs, you may still receive communications from the sender for non-marketing purposes, for example in connection with a pending order or customer service issue.

How can I review and update the personal information you have about me?

If you would like to review, correct or delete your personal information, you may be able to do so by logging into your account with the iMemories Site. Alternatively, you may contact us at the contact information below. There may be times when we are unable to fulfill your request - for example, if providing access to your personal information would reveal confidential commercial or proprietary information or personal information about someone else (and we cannot separate your data), if we are prohibited by law from disclosing the information or if we have a legal obligation to retain certain data. We may require additional personal information from you for the purposes of verifying your identity and rights.

Your California Privacy Rights

Under California law, a California resident with whom a iMemories Company has an established relationship has the right to request certain information with respect to the types of personal information the company has shared with third parties for their direct marketing purposes, if any, and the identities of those third parties, within the immediately preceding calendar year, subject to certain exceptions. All requests for such information must be in sent by email to privacy@iMemories.com.

Additionally, California residents under 18 who are registered users of a website can request removal of content or information posted by the user on this Site by emailing us at privacy@iMemories.com with “California Minor Content Removal Request” on the subject line and in the body of your message. Please specify in your request the URL of the website to which your request relates and the specific information or content you posted for which you are requesting removal.

Your Nevada Privacy Rights

Nevada Revised Statutes Chapter 603A entitle Nevada users to certain opt-out rights. While you can always contact us at privacy@iMemories.com with any questions, please know we do not currently sell data trigging that statute's opt-out requirements..

Children

The iMemories Site is not intended for children under 18 years of age. The Children's Online Privacy Protection Act protects the online privacy of children under 13 years of age. California residents under 16 years of age may have additional rights regarding their information. We do not knowingly collect or maintain personally identifying information from anyone under the age of 16. If you are under 16, do not use or provide any information on the Website or through any of its features or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. No Control of Third Party Sites

Please be aware that websites that link to the iMemories Site, or which the iMemories Site links to, may collect personal information about you. You should consult the other sites' privacy policies as we have no control over information that is submitted to, or collected by, these third parties.

Policy Updates

By using the iMemories Site, you consent to our use of your information as described in this Privacy Policy. As we implement new technology and introduce new services, or in response to changes in applicable laws or regulations, we will update this Policy, so we encourage you to review it often. We reserve the right to change this Privacy Policy at any time without advance notice. We will identify an updated version of this Policy with a revised effective date. Changes to our Policy will become effective when posted.
